Information on the rights of the persons affected

  • The person affected shall have the right to obtain confirmation from the person responsible as to whether personal data concerning him or her is being processed; if this is the case, he or she shall have a right of access to such personal data and to the information listed in Art. 15 of the GDPR.
  • The affected person has the right to obtain the rectification of inaccurate personal data concerning him or herself without delay and, where applicable, demand the completion of incomplete personal data (Art. 16 GDPR) from the person responsible.
  • The affected person has the right to request the person responsible to erase personal data concerning him or herself without undue delay, provided that one of the reasons listed in Art. 17 of the GDPR applies, e.g. if the data is no longer needed for the purposes pursued (right to deletion).
  • The affected person has the right to request the person responsible to restrict processing if one of the preconditions listed in Art. 18 of the GDPR applies, e.g. if the person affected has objected to the processing, for the duration of the person responsible’s review.
  • The person affected shall, at any time, have the right to object, on grounds relating to his or her particular situation, to the processing of personal data concerning him or her. The person responsible shall then no longer process the personal data unless it can demonstrate compelling legitimate reasons for the processing which override the interests, rights and freedoms of the person affected; or
  • the processing serves the purpose of asserting, exercising or defending legal claims (Art. 21 GDPR).
  • Without prejudice to any other administrative or judicial remedy, any person affected shall have the right to lodge a complaint with a supervisory authority if the person affected considers that the processing of personal data relating to him or her infringes the GDPR (Art. 77 GDPR). The person affected may exercise this right before a supervisory authority in the member state of his or her residence, place of work or the place of the alleged infringement.
  • In Hesse, the competent supervisory authority is: The Hessian Data Protection Officer for Data Protection and Freedom of Information, Gustav-Stresemann-Ring 1, 65189 Wiesbaden.
